These Terms of Service (the "Terms") govern your use of www.forteflora.com and any related pages, content and services (together, the "Site"), and every order you place with us. The Site is operated by Muntix Limited, Unit 1603, 16/F, The L. Plaza, 367-375 Queen's Road Central, Sheung Wan, Hong Kong, trading as forteflora ("forteflora", "we", "us", "our").

By browsing the Site or placing an order you accept these Terms. If you do not accept them, please do not use the Site. Our Privacy Policy, Shipping Policy and Refund Policy form part of these Terms and are incorporated by reference.

1. Who can buy from us

You may use the Site and place an order only if you are at least 18 years old and legally able to enter into a binding contract. Our products are dietary supplements intended for adults. They are not intended for children, and you may not buy them on behalf of anyone under 18.

We currently sell and ship only within the United States, with the exception of Alaska and Hawaii. If you order from anywhere else, we may cancel the order and refund you.

2. Your account

You can order as a guest or create an account. If you create one, you are responsible for keeping your login details confidential and for everything that happens under your account. Tell us promptly at info@forteflora.com if you believe someone else has used it. You must give accurate, current and complete information when you order, and keep it up to date, so that we can complete your purchase and reach you if something goes wrong.

3. Orders and acceptance

An order you place is an offer to buy. The contract between us is formed only when we send you a confirmation that your order has been accepted, or when we dispatch it, whichever comes first. An order confirmation email that simply acknowledges receipt is not acceptance.

We may refuse or cancel any order, in whole or in part. Reasons include a product being unavailable, an error in the price or description, a failed payment or fraud check, an order that appears to be for resale, or a shipping address we cannot serve. If we cancel an order you have already paid for, we refund you in full.

4. Prices, payment and taxes

All prices are in US dollars and are shown excluding shipping unless stated otherwise. Applicable sales tax is calculated and shown at checkout. Prices, promotions and product availability can change at any time before you place an order.

By submitting an order you confirm that you are authorised to use the payment method you provide, and you authorise us and our payment processors to charge it for the full order amount including shipping and tax. Payments are handled by third-party processors. We do not store your full card details.

If a product is listed at an obviously incorrect price because of a technical or human error, we are not obliged to supply it at that price. We will contact you, and you can either confirm the order at the correct price or cancel it for a full refund.

Taxes, duties and bank charges. Prices on the Site are shown excluding tax. Any sales or use tax that applies is calculated at checkout on the basis of your delivery address, and is added to the amount you pay. Anything a third party charges on top of that is for your account, not ours: if an order is ever shipped to an address outside the United States, all customs duties, import taxes, brokerage and handling charges are set by the destination country, are not collected or received by us, and are payable by you as the recipient before or on delivery. The same applies to any currency-conversion or foreign-transaction fee your bank or card issuer adds. We cannot calculate these amounts in advance, we never receive them, and we cannot refund them, including where a parcel is refused, unclaimed or returned because such charges were not paid. Refusing a parcel for that reason is not a return under our Refund Policy.

5. Subscriptions and recurring orders

Where we offer a subscription option such as Subscribe & Save, the following applies in addition to the rest of these Terms.

• Choosing a subscription authorises us to charge your payment method automatically on each renewal date, at the subscription price in force at that time, until you cancel.
• Your subscription renews automatically at the interval shown at checkout. We send you a reminder before each renewal charge.
• You can pause, change the interval, skip a delivery or cancel at any time from your account or by emailing info@forteflora.com. To avoid being charged for the next delivery, do so at least three days before the renewal date. Cancelling does not affect an order that has already been processed.
• We will tell you in advance if we change the price of an existing subscription, and you may cancel before that change takes effect.
• Subscription discounts cannot be combined with other offers unless we say so.

6. Shipping and delivery

Delivery times, rates and the free-shipping threshold are set out in our Shipping Policy. Delivery windows are estimates, not guarantees, and can be affected by carriers, weather and peak periods. Risk of loss passes to you when the carrier delivers to the address you gave us. Carrier delivery confirmation is treated as proof of delivery. If an address you supplied is wrong or incomplete and the parcel is returned or lost as a result, we are not responsible for reshipping at our cost.

7. Returns, refunds and the 90-day guarantee

Every order is covered by our 90-day money-back guarantee, counted from the day your order is delivered. The full conditions, including how multi-bottle orders and damaged or incorrect items are handled, are in our Refund Policy. Where that policy and these Terms differ on a point about returns or refunds, the Refund Policy applies. Nothing in these Terms limits rights you have under mandatory consumer law that cannot be waived.

8. Dietary supplements: important health information

Our products are dietary supplements. They are not medicines. Statements about them have not been evaluated by the Food and Drug Administration, and the products are not intended to diagnose, treat, cure or prevent any disease.

Nothing on the Site is medical advice, and nothing on it replaces a consultation with a qualified healthcare professional. Talk to your doctor before starting any supplement, particularly if you are pregnant or breastfeeding, are taking prescription medication, have a medical condition, or are scheduled for surgery. Read the label before use, do not exceed the recommended serving, and stop taking the product and seek advice if you experience an adverse reaction.

Individual results vary. Where the Site shows customer reviews or testimonials, they describe individual experiences and are not a promise that you will experience the same thing.

9. Personal use only

Products are sold for your own personal use. You may not resell, redistribute or export them, and you may not present yourself as an authorised reseller of forteflora. We may cancel orders that appear to be placed for resale.

10. Reviews, comments and other submissions

If you send us a review, photo, suggestion or other material, you grant us a non-exclusive, worldwide, royalty-free, perpetual and transferable licence to use, reproduce, adapt and publish it in connection with our business, including in marketing, without payment or attribution. You confirm that the material is your own, that it is accurate, that it does not infringe anyone else's rights, and that it contains nothing unlawful or abusive.

We are not obliged to publish or keep any submission, and we may edit or remove material at our discretion. We do not accept confidential ideas or proposals, and we are not liable for any submission you choose to send us.

11. Acceptable use of the Site

You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorised access to it, to interfere with its operation or security, to introduce malicious code, to scrape or harvest data from it by automated means, to infringe our or anyone else's intellectual property, or to harass, abuse or mislead others. We may suspend or terminate your access if you do.

12. Intellectual property

The Site and its content, including text, images, product photography, label artwork, layout, graphics and the forteflora name and logo, are owned by or licensed to us and are protected by intellectual property law. You may view and print pages for your own personal use. Any other use, including copying, republishing, or using our brand or content commercially, requires our prior written permission.

forteflora is a supplement brand for people. We are not affiliated with, endorsed by, or connected to FortiFlora, a probiotic for pets sold by a different company. Any other trade marks appearing on the Site belong to their respective owners.

13. Third-party links, tools and social media

The Site may link to third-party websites, and it may use third-party tools and platforms, including payment processing, fulfilment, analytics and social media. Those services are provided on an "as is" basis and are governed by the third party's own terms and privacy practices. We do not control them, we do not endorse their content, and we are not responsible for them. Interacting with us on a social media platform is subject to that platform's rules as well as these Terms.

14. Accuracy of information

We work hard to describe our products accurately, but the Site may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, ingredients, pricing, promotions or availability. We may correct any error and update or cancel affected orders at any time, without prior notice. Screen colours and packaging photography may differ slightly from the product you receive. Product labels can change, so always read the label on the bottle you have.

15. Disclaimer of warranties

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, secure or error-free, or that any content is complete or current. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data or goodwill, arising out of or in connection with the Site, our products, or these Terms, whether based in contract, tort or any other theory, even if we have been advised of the possibility.

To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with any order or your use of the Site is limited to the amount you actually paid us for the order giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, or for fraud.

17. Indemnity

You agree to indemnify and hold harmless Muntix Limited, its directors, officers, employees and suppliers from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

18. Resolving disputes

Talk to us first. If something goes wrong, email info@forteflora.com with your order number and a description of the problem. Most issues are solved this way within a few days, and we ask that you give us 30 days to resolve a dispute informally before starting any formal proceedings.

Arbitration. If we cannot resolve a dispute informally, you and we agree that it will be settled by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration may be conducted by document submission, telephone or videoconference, or in person in the US state where you live. The arbitrator's decision may be entered as a judgment in any court with jurisdiction.

No class actions. Disputes will be brought only in an individual capacity. You and we waive any right to bring or participate in a class, collective, consolidated or representative action.

You can opt out. You may opt out of this arbitration and class-waiver section by emailing info@forteflora.com with the subject line "Arbitration opt-out", together with your name and order number, within 30 days of your first purchase. Opting out does not affect the rest of these Terms.

Small claims and injunctions. Either of us may bring an individual claim in small claims court, and either of us may seek injunctive relief in court to protect intellectual property rights.

19. Governing law

These Terms and any dispute arising out of them are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law rules. If you are a consumer resident in the United States, this choice of law does not deprive you of the protection of mandatory consumer-protection rules of the state in which you live.

20. Changes to these Terms

We may update these Terms from time to time. The current version is always on this page, with the date at the top. Changes take effect when published, and the version in force at the moment you place an order governs that order. Continuing to use the Site after a change means you accept the updated Terms.

21. Termination and survival

These Terms apply while you use the Site and remain in force for as long as necessary to settle any outstanding obligation between us. We may suspend or terminate your access at any time if you breach them. Sections 8, 10, 12, 15, 16, 17, 18 and 19 survive termination.

22. General

• Entire agreement. These Terms, together with the policies referenced in them, are the entire agreement between us and replace any earlier understanding on the same subject.
• Severability. If any provision is found unenforceable, it is severed or limited to the minimum extent necessary and the rest stays in force.
• No waiver. If we do not enforce a right, that is not a waiver of it.
• Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor or affiliate.
• No agency. Nothing here creates a partnership, joint venture, employment or agency relationship between us.
• Electronic communications. You agree that we may communicate with you electronically, and that emails and notices posted on the Site satisfy any legal requirement that a communication be in writing.
• Events beyond our control. We are not liable for delay or failure caused by events outside our reasonable control, including carrier disruption, supply shortages, natural events, industrial action or government measures.
